Assisted Suicide is now Legal in Canada!

Friday, February 6th, 2015, will be known as one of the most significant days in Canadian jurisprudence – the Supreme Court of Canada struck down Canada’s ban on doctor-assisted suicide.  Simply put, this is one of the most significant rulings in the history of Canada – it is a ruling that will have ramifications throughout all of Canada’s legal system, and even throughout the American legal system as well.

Canada’s ruling on gay marriage has been frequently cited in American jurisdictions seeking to overturn or strike down same-sex marriage bans.  There is no doubt that Friday’s ruling on doctor-assisted suicide will have the same (if not, even more profound) impact.

Even an cursory contemplation of this ruling, gives rise to a litany of legal questions that will take decades of litigation to answer.  What will be the impact on the Charter, Religious Freedoms, Civil Rights, Doctors’ Rights…etc?  I, like many others, will paying close attention to Parliament’s reaction, if any.

BLF Tip of the Day – Your Silence is your Statement

It’s human nature:  we want to explain our side of the story, or we want to tell another person what happened; or, in the extreme, we want to clear our conscience.  But the interview room at the police station, or the backseat of a police cruiser, is the WORST place to give in to that natural instinct.

If a client is being charged with a crime and is under arrest, our number one piece of advice is to remain silent!  At that point, there is nothing that can be said that can make that situation any better.  Nothing.  Unfortunately, the reverse is NOT true: anything that is said at that point, will usually make things worse – a LOT worse.

So, if human nature is impossible to suppress, and words need to be said, make that statement in the confines of a lawyer’s office where the Attorney-Client or Solicitor-Client Privilege is in effect.

Your silence IS your statement.

Honoring the great Dr. Martin Luther King, Jr.

Today is known as “Martin Luther King, Jr.” day, and I am among the millions of people who have been inspired this great man.  In fact, his work and his legacy formed part of the very reason why I went to law school in the first place – I wanted to give a voice to those who would otherwise be ignored.  But, Dr. King did so much more than simply give a “voice” – he gave all of us an ideal to strive toward; he gave us his “Dream”.

That timeless speech, in my opinion, is one of the greatest speeches in recorded History.  I have listened to his words time and again, and each time I am humbled.  For my part, of particular importance of his words: “I have a dream where my four little children will one day live in a nation where they will not be judged by the color of their skin but by the content of their character.”  Like many others, I share that dream – that we should all be judged by the content of our own characters.

So, while we live through our daily lives, I hope that we may be able to take the time to honor the great Dr. Martin Luther King, Jr., in our own, personal ways.

Republicans Dominate, and now the Questions Begin.

It was election night, and the Democrats have been dominated by the GOP.  So now what?  Where does that leave the battle between the President and Congress?  More importantly, has this made things better or worse?  With a surprising number of States that went from Blue to Red, at least one thing seems clear: the voters are not happy with the status quo and something needs to change, and soon!

Among the multitude of questions, the most pervasive question now is: Who is going to be running for the Big Chair?  Hillary?  Christie?  Above all else, I suspect a lot of people are wondering if the Democrats even have a shot at winning the Presidential Campaign?

As for us criminal lawyers, what changes are coming down the line?  And what is going to be done about the blatant conflict of laws between the State laws that allow Medical Marijuana, and the Federal Government that still has weed listed as a Schedule I, controlled substance?  Are the dispensaries going to have to shut down?

So many questions…and so little time.  It’s going to be a rollercoaster of a ride for the next 2 years.  Hang on tight!

Dear Terrorists: “Canada will never be Intimidated.”

Dear Terrorists:

You have sought to wreak havoc and chaos by striking at the very heart of a peaceful and beloved nation.  You have tried to sew fear and paranoia by corrupting two of our own, and turning them into instruments of your Evil.  You have tried to do all of this by murdering our honoured soliders, Cpl. Nathan Cirillo and Warrant Officer Patrice Vincent.

You have failed.

Canada is a peace-loving nation, populated by a multi-cultural people from every walk of life; from nearly every nation in the World.  Diversity is the very definition of Canada’s culture, as is acceptance and a celebration of that diversity.  Fear and loathing have no place in our hearts; they have no place in our minds.

Just as you feed off of Fear, so shall you starve from Canada.  As Prime Minister Harper bluntly said, “Canada will never be intimidated.”

Your mission is a failure; and your cause is a loss.

BLF’s Michigan Office has New Signs Up!

I realize that I might be making a “big deal” out of something that seems to be so trivial but when we consider that the things that I once took for granted (i.e. corporate logos, business cards, letterhead, signage, etc.), have so much time and effort, seeing the signage for the Okemos, MI office, is another small victory for BLF.  Having a sign on the door and on the building directory gives the Okemos office a sense of permanency and stability – not to mention the fact that we no longer have to give our clients step-by-step directions on how to find our Michigan office.

Now if we could just get the London office that much closer to completion :)…..(I say that with love and affection)….

Crimes Involving Moral Turpitude: A List and Corresponding Citations

After reading through more cases than we ever did during all of the Law School, we have compiled a list (and accompanying case citations) of Crimes Involving Moral Turpitude!!  To be clear, what we have compiled thus far, is merely the raw data.  We will be going through this information in greater analytical detail, at a later date.  But at the very least, readers are able to get the general idea of what is and is not a Crime Involving Moral Turpitude.

None of this information is meant to replace individual research.  We have done our best to be as accurate as possible.  However, each case is unique and each client’s needs are particular.  This list is only meant to be a starting point, or (at the very least) an interesting conversation-starter.

EMDC: the new Tourist Stop for Politicians

According to this London Free Press article, Minister Yasir Naqvi toured the Elgin-Middlesex Detention Centre on Wednesday night.  Here is the link to the article:

According to that same article, EMDC has had visits from a group of bureaucrats, NDP MPP Lisa Gretzky, and now Minister Naqvi himself.  After his visit, the Minister issued more platitudes, more promises, and more political commitments to change.

So, what?!

Even if the Prime Minister himself came down from Parliament Hill, I would still be asking the same question – so, what?

When people are DYING, words mean next to nothing.  When people are being treated like caged animals, illusory promises are painfully insulting.  When change is so desperately needed, platitudes are downright pathetic.  The Task Force who was supposed to be dealing with this, has been deathly silent, while the conditions at EMDC worsen day by day.

EMDC doesn’t need more political visits – it needs action, it needs change.  Least of all, it does not need to become the new Tourist Stop for Politicians.

Rebecca Ford: 1 Year Later

Dear Ms. Rebecca Ford,

In honour of your 1 year work anniversary, BLF would like to present you with a very unorthodox present: a Harley Quinn Collector’s Statue.  After 3 comic book stores, and a venture into the dimensions of comic books and graphic novels, I’m very happy that you like your present.

Over the past year, you have brought sanity to my “organized chaos”, as you put it.  Thank you for your hard work, your dedication, your million-and-one questions…and above all else, thank you for your commitment to BLF and our clients.  I brag about your excellence to all who will listen, and I mean every word of it!

Thank you for an incredible year.  We are very much looking forward to another year of “pure awesomeness” :).

Elgin-Middlesex Detention Centre (EMDC): Ontario’s Modern-Day Tower of London?

During the 16th and 17th centuries, the famous (infamous) Tower of London served as a prison for nobles and royalty. Barbaric conditions and brutal executions were the norm and it would seem that the Elgin-Middlesex Detention Centre (EMDC), in London, ON, is quickly becoming Ontario’s modern-day version of that historical site.

It has been slightly less than a year where Adam Kargus was beaten by another inmate, and left to die by EMDC staff. That resulted in EMDC staff being fired, investigated, and criminally charged. And, just this week, another inmate tried to hang himself and later died at EMDC – this, while supposedly being held in segregation. To make matters worse, the in-fighting has caused an appalling number of lockdowns and denials of basic, human necessities such as food, medication, and showers.

Draconian conditions abound: Inmates who have lived under these conditions, have resorted to rioting, which has led to floodings, fires, and other assaults. Sanitary conditions have degenerated to the point where mold has grown on some of the tables in the jail. Three people locked in cells designed for two has led to inmates engaging in fighting amongst themselves.

I certainly grant that the purpose of jail is to punish. But, what of those who are held while their cases are still pending? Worse yet, what of those who are held but whose cases are eventually withdrawn? These people would have lived through Hell for virtually no reason. And, given it’s purpose of punishment, that does not equate to torture – and certainly not to the level of this suffering.

Apparently, there is a task force that has been setup to address the issues going on at EMDC.  But, so far, the only action that has been reported in any way, shape or form, has been a tour of the facility.  People are dying, and the only thing that is being done is…is…what?

The modern day version of the Tower of London is not a “nickname” that any institution should desire.  Sadly, EMDC is barreling in that direction and Death and Destruction are left in its wake.
